SettlePou Prevails in Eminent Domain Lawsuit in Favor of a National Restaurant Chain

Dan Tobin and SettlePou successfully resolved an eminent domain lawsuit in favor of its client, a national restaurant chain.  The principal issue in the condemnation lawsuit, which was filed by the State of Texas for the construction occurring along Interstate 35, was the restaurant’s loss of a significant amount of its parking lot that caused numerous operational and legal issues as a result of the taking.  Under Texas condemnation law, the State of Texas is required to make a bona fide offer to purchase any property it is taking by eminent domain before the condemnation lawsuit can be filed.  Here, Dan in working with his client, secured payment for the fair market value of his client’s property being condemned that was more than twice (2xs) the amount of the State of Texas’s pre-lawsuit offer.
