The Probate, Trust and Guardianship Administration and Litigation Group represents clients in probate, trust and guardianship administrations in all probate and state courts in Texas, in addition to representation in adversary proceedings which occasionally accompany these proceedings. Probate administration in Texas is one of the simplest and least expensive in the country, if a well-considered and well-drafted estate plan is developed prior to death. The concept of "independent administration,” which is incorporated into all well-drafted Texas wills, allows the estate representative to go about the duties of administering a decedent’s estate with minimal supervision of the court system and, accordingly, relatively lower legal fees than commonly charged in other states. Failure to provide for an independent administration can increase the cost of probate substantially, and failure to provide for any estate plan at all can increase the cost of probate exponentially. The group also represents clients in litigation matters which commonly occur in these practice areas, such as will contests, competing applications for administration, the construction and amendment of trusts, the establishment of guardianships for minors and incapacitated persons, and the representation of creditors in collection matters against estates.
